§ 1 Scope

These Terms of Use apply to all content, subdomains and services provided by Teneriffa News. By using the service, the user agrees to use the service provided by Teneriffa News solely in accordance with applicable law and these Terms of Use. Teneriffa News provides news, information on various topics, and other content and services. This content is freely accessible to everyone.

§ 2 Links and advertising

Links to third-party websites within the context of Teneriffa News refer to content external to Teneriffa News. They do not constitute offers from Teneriffa News, but are merely references to other websites. Teneriffa News has no technical or actual influence over such websites and does not endorse the content accessible on them. Similarly, Teneriffa News is neither responsible nor liable for the availability of such external websites and excludes any liability or warranty in relation to them, unless it can be proven that it had actual knowledge of unlawful content. Teneriffa News does not endorse the content of banners and other advertising spaces and accepts no liability for them.

§ 3 Rights to the content

The content provided by Teneriffa News may only be used for your own personal purposes. The distribution of content from Teneriffa News to third parties, even in part, is only permitted if Teneriffa News provides electronic support for this and express consent has been given. Furthermore, the copying, exploitation, distribution, publication and any other use of the content from Teneriffa News for one’s own or third parties‘ commercial purposes is prohibited.

Teneriffa News reserves the right to discontinue, expand or restrict content at any time. It is prohibited to alter and/or remove copyright notices and/or trade marks and/or other information contained in the content.

It is prohibited to create a hyperlink to Teneriffa News if the page containing this link to Teneriffa News includes content that is morally offensive, glorifies violence, is racist and/or constitutes a criminal offence.

§ 3.1 Exception regarding the use of our content

In exceptional cases, the use of our content may be permitted. This is expressly the case only where the content is used for private purposes and only individual sentences – or, at most, the first paragraph in its entirety – are quoted, followed by a link to the original text at Teneriffa News. In all other cases, and without restriction in the case of commercial use, the use of our content is prohibited in accordance with Section 3.

§ 4 Warranty and Liability

Teneriffa News does not guarantee that the content will meet the user’s expectations or that the content will enable the user to achieve a specific objective they are pursuing.

Furthermore, Teneriffa News does not guarantee that the service provided by Teneriffa News will be available at specific times. In particular, Teneriffa News therefore accepts no liability in the event of disruptions, interruptions or any failure of Teneriffa News.

Some of the content published on Teneriffa News is provided by third parties. Teneriffa News and its data suppliers cannot guarantee the accuracy, completeness or timeliness of this content. Any warranty is therefore excluded unless otherwise specified in these Terms of Use or in the Terms of Use of the data suppliers.

Teneriffa News accepts no liability for any loss of the user’s information or data.

§ 5 Data Protection

Teneriffa News will strictly comply with all data protection regulations.

§ 6 Copyright & Readers writing for readers („reader reporters“)

If the user submits a post, text, image or graphic protected by copyright or other legal rights to Teneriffa News , they thereby grant Teneriffa News, free of charge, a comprehensive right of use over the content, unlimited in terms of geographical scope and duration, for the corresponding redistribution on Teneriffa News, including the right to edit, adapt and translate the content, and to exploit it electronically or digitally, in whatever form and on whatever medium. Teneriffa News assumes that the submitter has clarified the rights to their submission (text, image, etc.) and does not rigorously verify this itself. In the event of a copyright dispute, Teneriffa News will store the name, email address (which will not be published) and IP address (which will also not be published) in order to be able to investigate possible copyright infringements. Any claims for compensation or other amounts in dispute will be passed on to the submitter.

No payment will be made for submitted texts, images or other content. Teneriffa News reserves the right to publish submitted texts, images and graphics, including separately from one another and in a different context, even for commercial purposes. Moral rights remain unaffected, in particular the right to prohibit actions, other infringements or uses that are likely to jeopardise legitimate intellectual and personal interests in the contributions.

It is strictly prohibited to use the comments section, the ‚Readers write for readers‘ section or any other sections – including those to be introduced in the future – on Teneriffa News for commercial purposes, unless written permission has been granted. Advertisements, links or promotional content will be deleted. In the event of repeated attempts to do so, a user may be banned from the relevant sections or even from all services on Teneriffa News. There is no right to the publication of a post, not even for subscribers. No refund of the (subscription) fee will be paid in such cases. Furthermore, this does not automatically terminate the subscription. The subscriber remains obliged to cancel the subscription in good time.

§ 7 Subscriptions

Teneriffa News offers various subscriptions. The differences lie primarily in the subscription period and the scope of services. For example, paying customers have greater access to the portal at www.teneriffa-news.com (no other subdomains) and see fewer adverts there, provided this is included in their particular subscription package. The amount of advertising varies depending on the subscription option, as specified in the description of the relevant membership on the order page. „Distracting advertising“ is defined here as adverts that interrupt the flow of reading across the full width of the article (excluding adverts in embedded videos).

Furthermore, it is possible that parts of the portal or additional services may be reserved exclusively for customers (see § 8). At present, it is not possible to guarantee that the portal will be entirely free of advertising, partly for technical reasons. This applies both to the portal www.teneriffa-news.com and to the newsletter, which may be sponsored on a per-issue basis. This is indicated, for example, by phrases such as ‚presented by‘. The newsletter is an optional part of the subscription. Subscribers automatically receive the newsletter for subscribers. Following any cancellation of membership, the newsletter is usually automatically converted to the newsletter for non-subscribers. There is no entitlement to this conversion. We have no control over the delivery of either newsletter, for example due to spam filtering. If you do not wish to receive the newsletter, you can easily unsubscribe at the end of each issue. The Teneriffa News subscription is not automatically cancelled by unsubscribing from the newsletter.

If your email provider repeatedly blocks our newsletters, we will stop sending them to your address, even if you are a member. As a member, there are various ways you can help improve delivery rates, such as adding our sender address to your online address book or actively marking our messages as ‚wanted‘.

Subscriptions commence immediately upon payment and are automatically renewed for the relevant membership period. You may cancel your subscription at any time, effective at the end of the relevant subscription period. To do so, you will be redirected to the selected payment service provider with a single click. There, you can amend your payment details and cancel your subscription. Teneriffa News ensures that the button required to cancel the subscription/membership is available and can be used in the ‚Your Membership‘ section of your profile. Cancellations can only be made via your profile (log in via the blue ribbon at the very top, then click on ‚Go to profile‘). Cancellation via the contact form is not possible.

Subscriptions taken out via PayPal before 2023 must be cancelled via the PayPal portal. To do this, you must log in directly at paypal.de using your PayPal login details and follow the instructions for cancelling subscription payments made via PayPal.

All subscriptions include all taxes and fees. They are automatically renewed for the respective period upon expiry of the subscription term. Cancellation must be made via the method mentioned above at least one day before the end of the subscription period. Otherwise, the subscription will automatically renew for the specified period. Earlier cancellation is possible; in this case, the subscription will remain active until the end of the contract. It is not possible to temporarily suspend the subscription, nor is it possible to receive a refund of subscription fees for partial periods. It is also not possible to reverse the payment for a subscription period that has just begun. If this is requested from the payment service provider, costs will be incurred which will be invoiced to the customer by Teneriffa News. For monthly subscriptions, these costs may exceed the actual subscription price.

Access to the subscription is password-protected and is provided via remote data transmission using the login details (email address, username and password) assigned to the customer for their personal user account.

Customers are obliged to keep their login details confidential and to prevent unauthorised use of the online access by third parties. Use of the subscription is always restricted to one user and/or workstation. For each user account, use of our service is permitted exclusively on the customer’s own devices. Any use beyond this must be agreed with Teneriffa News. If several people work at the customer’s address and/or within the customer’s organisation, the customer shall ensure that users working within their organisation comply with the obligation to keep login details confidential and to prevent their unauthorised use.

Teneriffa News reserves the right to offer vouchers for selected subscriptions or to selected subscribers. The subscription voucher entitles the holder to redeem it for a selected subscription. Vouchers are valid for a limited period. There is no entitlement to use them at a later date. Refunds are not possible. Teneriffa News will provide timely notice of any price increases.

The subscription applies exclusively to the digital content specified in the subscription description, which is available at Teneriffa News, and not to the websites of (content) partners. The content is generally available online to subscribers throughout the entire publication period. There is no entitlement to a minimum number of new daily or weekly items. The same applies to the frequency of the newsletter specified in the subscription. This is published regularly. Teneriffa News makes every effort to ensure this takes place weekly. However, there is no entitlement to this frequency. Furthermore, it is possible that the Teneriffa News portal may be temporarily unavailable in its entirety, for example due to technical problems. This does not constitute a general right to early termination or a partial refund.

The subscription service offers various ways of placing orders and making changes to subscriptions and customer details (in writing, in text form, by telephone and via the online service). Teneriffa News may exchange information and documents (e.g. contractual correspondence, billing and payment documents) with the customer for the purpose of contract fulfilment by telephone, in writing or by electronic means, in particular in text form via email and via the online service. This includes, where applicable, direct marketing in electronic form in accordance with Section 7(3) of the German Unfair Competition Act (UWG). The customer may object to this direct marketing at any time by sending a written notice to Teneriffa News, quoting the keyword ‚objection to marketing‘, without incurring any costs other than the transmission costs in accordance with the standard rates.

§ 7.1 Right of withdrawal

The right of withdrawal expressly does not apply to our digital subscription (also referred to as a ‚membership‘). The reason for this is that we commence performance of the contract by providing immediate access in real time, and thus even before the confirmation email has been sent. The provision of the service therefore begins before the expiry of the 14-day withdrawal period that is customary in other cases. By agreeing to our Terms and Conditions, you have consented to the immediate performance of the contract upon taking out a digital membership and, consequently, to the automatic forfeiture of your right of withdrawal.

By taking out a subscription, you agree to the terms set out in clauses 7 and 7.1, as well as all other parts of the contract.

§ 8 Services

Teneriffa News offers a range of services. For example, there is an read-aloud function, a calendar, the „Readers write for readers“ section, and other additional services, including those to be introduced in the future. Teneriffa News reserves the right to make such additional services available exclusively to subscribers. Furthermore, these may be discontinued if the level of usage does not justify the associated costs or if the costs exceed the benefits. This also applies if such services were listed as part of the contract at the time the subscription was taken out. There is no special right of termination should one or more additional services be discontinued. Nor will the subscription price be reduced as a result of the discontinuation of one or more ancillary services, nor will a retrospective discount be applied. Teneriffa News is under no obligation to offer these services on a permanent basis. Furthermore, the scope of these services is expressly not defined. There is therefore no guarantee that every article will be equipped with a read-aloud function, nor is there any guarantee regarding the quantity or quality of the events.

§ 9 Invoicing

9.1 Teneriffa News processes its subscriptions via the payment service provider Stripe. If the SEPA payment method is selected, payment processing is carried out by the payment service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (hereinafter: „Stripe“). In this case, Stripe will debit the invoice amount from the customer’s bank account after a SEPA direct debit mandate has been issued, but not before the expiry of the pre-notification period. Pre-notification refers to any communication (e.g. invoice, policy, contract) sent to the customer announcing a debit via SEPA direct debit. If the direct debit is not honoured due to insufficient funds in the account or because incorrect bank details were provided, or if the customer objects to the debit despite not being entitled to do so, the customer shall bear the fees arising from the reversal by the relevant credit institution, provided that they are responsible for this. Teneriffa News reserves the right to carry out a credit check when the SEPA direct debit payment method is selected and to reject this payment method if the credit check is unsuccessful.

9.2 If you choose to pay by credit card, Apple Pay or Google Pay via Stripe, the invoice amount is due immediately upon conclusion of the contract. Stripe reserves the right to carry out a credit check and to refuse this payment method if the credit check is unsuccessful.

9.3 The previous payment service provider was PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter „PayPal“). New customers can no longer take out subscriptions with Teneriffa News via PayPal.

§ 10 Comments & Netiquette

The internet is not a space free from legal and moral constraints. On our social media channels and in the comments section of Teneriffa News, we wish to communicate and interact with our readers and subscribers. Praise, criticism and comments regarding our content and the topics covered are expressly welcome. However, we reserve the right to delete comments – including those from paying subscribers – and to temporarily or permanently ban ‚repeat offenders‘ – including paying subscribers – from using the comment function on Teneriffa News or on our social media channels. Each user is responsible for the posts they publish themselves. Teneriffa News accepts no liability. Suspensions are imposed for good cause – for example, if our netiquette is breached. A suspension does not constitute grounds for early termination of the subscription. Compliance with netiquette is the responsibility of each individual. § 11 Kanaren-Kleinanzeigen

At www.kanaren-kleinanzeigen.com, users have access to a classifieds portal. The prices for placing a classified advert are communicated during the process of placing the advert. The classifieds portal is not part of the editorial subscription or membership taken out at www.Teneriffa News.com. However, we reserve the right to provide subscribers with discount codes of varying values. Subscribers are expressly not entitled to any discounts.

Teneriffa News, together with Kanaren-Kleinanzeigen, provides an online service through which users, as advertisers, can create and publish offers and requests (hereinafter „advertisements“) consisting of text, videos and images, and through which users, as interested parties, can view advertisements published by other users. Teneriffa News reserves the right to make minor adjustments to the text or headlines of advertised listings. This includes the removal of links, at least where they have clearly been included as part of a link-building strategy. Even paid advertisements do not expressly confer the right to include links.

In addition to the adverts service itself, we also facilitate the exchange of electronic messages between advertisers and prospective customers. The service is intended for the publication of adverts and for bringing together suppliers and prospective customers for the goods and services advertised. Kanaren-Kleinanzeigen is not itself a supplier of the products advertised in the respective adverts. As part of the advert display and on a user’s overview page, we show additional information about the user and their activities (for example, details of their response rate and/or average response times to enquiries). We may also categorise users according to certain criteria.

We bring sellers and prospective buyers together. Teneriffa News acts as a neutral intermediary in this process. The transaction and all related procedures are carried out between the two parties without the involvement of Teneriffa News. We accept no liability whatsoever. Failed transactions, warranty claims, damaged goods, transport damage, non-performance and any other issues are to be resolved between the seller and the prospective buyer/purchaser. Teneriffa News is also not involved in the further processing of a transaction between the seller/service provider and the prospective buyer. We do not carry out our own investigations. Should we be informed of fraudulent activities, we will assist the relevant authorities – to be consulted by the aggrieved party – to the best of our ability. We also reserve the right to suspend accounts that do not appear credible to us or in respect of which we receive multiple complaints. We ourselves do not provide any guarantees and do not pay any compensation.

We strongly recommend checking user accounts and offers for plausibility. Above all, we strongly advise that you always conduct business in person, particularly when large sums of money are involved.

We reserve the right to allow users to rate one another publicly, based on a specific interaction between them. Such ratings must comply with the rules of netiquette. We inform users via our newsletter system about newly posted items.
We publish and promote the classifieds service and the adverts posted by users, both ourselves and through third parties, for example by embedding the adverts or extracts thereof on other websites, in apps, emails, print campaigns or other media. We also enable third parties to advertise their offers and services. To support these activities, we may also provide third parties with access to the data, information and content published via the services. Users authorise us to use their adverts as described above for the purpose of promoting and increasing the reach of the service. This also applies to translations for the purpose of incorporating the translated adverts into foreign-language offerings.

The customer service team is available to all users free of charge for the submission of complaints and other enquiries. The customer service team documents complaints received, examines them carefully and will take any necessary action within a reasonable timeframe, whilst informing the user of this and of the outcome of the complaints procedure.

We enable users to sort search results according to various criteria (e.g. date posted, price). In addition, the search results also include adverts for which the respective advertiser has agreed to pay an additional fee to have them displayed prominently (e.g. as a featured advert).

A user account is required to place adverts; this can be created free of charge. The data collected through this account is handled in accordance with standard data protection practices, which you can view in our privacy policy. Teneriffa News is not responsible for any issues arising from the purchase or sale. We act solely as an intermediary between the buyer and the seller.

Sellers undertake to respect the copyright of any images, videos, text or other content they upload. Should any images, text or other content be used unlawfully on our portal, the user agrees to bear the costs of any legal action, formal notice or other legal proceedings, or claims for recourse, as well as any other associated costs.

Advertisers who book a paid package can use it to gain greater visibility. The details of what is included in the package are set out in the relevant offer.

Duplicate adverts will be deleted. In addition, classified adverts that essentially call for payments, donations or advertising, primarily for private or commercial purposes, may be deleted. There is no entitlement to the publication of an advert.

§ 11.1 Right of withdrawal

For our classified adverts, the right of withdrawal is expressly excluded when purchasing a paid package. The reason for this is that we commence performance of the contract by making the service available immediately in real time. The provision of the service therefore begins before the expiry of the standard 14-day withdrawal period applicable in other cases. By agreeing to our Terms and Conditions, you have consented to the immediate performance of the contract when placing a paid classified advert, and thereby to the automatic forfeiture of your right of withdrawal.

§ 12 Other provisions

These Terms of Use and the relationship between the user and Teneriffa News are governed exclusively by German law.

Teneriffa News is currently published exclusively in German and is aimed solely at German-speaking users within the EU.

Should one or more provisions of these Terms of Use be or become invalid, this shall not affect the validity of the remaining provisions. Rather, the invalid provision(s) shall be replaced, by way of supplementary interpretation of the contract, by one or more legally valid provisions which come as close as possible to the economic purpose recognisably pursued by Teneriffa News with the invalid provision(s). The same shall apply to the filling of any gaps in the provisions.

We do not participate in dispute resolution proceedings before a consumer arbitration board.

Teneriffa News reserves the right to amend these Terms of Use at any time with future effect.
