The mayor of Santa Cruz de Tenerife, José Manuel Bermúdez, announced on Monday that the City Council is preparing an appeal against the order issued by the Directorate-General for the Promotion of Democratic Memory, which reports to the Ministry of Territorial Policy and Democratic Memory, requiring the removal of the monument to Franco, on the grounds that there are legal arguments for retaining it due to its potential artistic value.
Speaking to the media, the mayor has argued that the legislation on democratic memory provides for the possibility of protecting items of this nature where they possess artistic merit, which must be assessed by the Municipal Commission for Historical Heritage.
«What am I asking for? That the law be applied. Not that the law should not be applied. That the law be applied as it is written,» said Bermúdez, who argued that certain articles of the legislation must be taken into account when assessing the monument’s future.

The mayor has emphasised that his position does not entail rejecting the application of current legislation, but rather advocating that all its provisions be taken into account, including those relating to heritage protection.
The City Council is working on preparing the appeal, which has not yet been lodged, according to Bermúdez.
